Somerset County Support Enforcement Attorneys
Appealing Support Enforcements in Central New Jersey
In order to enforce an order for support—or to request a change in the support amount—you must file a motion with the family court. The decision to enforce the order or not will take place after a hearing. If you disagree with the court’s decision, you have the option to appeal or take the decision to a higher court.
If you are having problems after a child or spousal support settlement, you do have options. Whether your former spouse is refusing to pay the court-ordered amount or proposing to increase the amount you must pay, there are court processes one of our family law attorneys can help you navigate that allow you to make your case.
Call Lane & Lane, LLC at (908) 259-6673 to find a Somerset County enforcement attorney who can discuss your case with you. We also serve Morris County, Union County, Middlesex County, and Essex County.
Consequences of Paying Back Support in Arrears
If the court decides in favor of the spouse filing the enforcement order, the spouse who owes support may incur a variety of consequences. If payments are not remitted, the funds may be garnished from wages or taken from any tax refunds. It’s also possible that the spouse’s driver’s license could be suspended, passport denied, or a judgment passed that prevents the individual from buying or selling property. As a last resort, a warrant may be issued for the spouse’s arrest.

“If you find yourself reading these reviews, you are clearly going through a tough time or helping someone who is. Going through a divorce can be devastating and it's far from easy. Eric Lane represented me for a number of issues over the course of over 18 months. His experience, demeanor, and thoughtful approach significantly helped make the best of an unfortunately difficult process. My short advice here is the process is what you make of it and Eric is a fantastic support to get you through it. Eric was responsive, fair, and transparent in all aspects. He took the time to understand what I wanted, and what my concerns were. I never felt rushed and always felt like he was fully vested in having a positive outcome. His advice was thoughtful, realistic, and I always felt like we had a game plan - which prepared me for what to expect each step of the way. I'm sure he has multiple clients at any given time, but with everything on his plate, I always felt like a priority. I would highly recommend anyone considering a divorce attorney to sit with Eric and get his opinion.”- Arpan S.
